Resolution of the Board of Directors

Special Assessment for Common Area Restoration
WHEREAS, the Association is responsible for the maintenance and repair of the common area, including but not limited to real property, roads, lakes, bayous, canals and walkway easements within the common area.
WHEREAS, the Association may levy a Special Assessment for re-construction, repair, replacement or extraordinary maintenance (e.g. hurricane clean up) of the Common Area or any capital improvement located thereon.
WHEREAS, Hurricanes Ian, Helene and Milton caused extraordinary damage to the Common Area.
WHEREAS, The Association Board established a Committee (the Restoration Committee) to evaluate the repair and restoration of the Common Area. The Restoration Committee evaluation included the following actions:
· Developed a landscape design (copy attached) to restore the entryway and traffic islands, noting that our entryway was (before the huricanes) a significant benefit to all owners and their property values.
· Consulted with nearby neighborhoods as to the special restoration assessments that they enacted. Finding that these assessments ranged from $2,000 to $20,000 per lot.
· Evaluated water and irrigation support for restored landscaping.
· Obtained bids from two qualified landscape installation companies: Landgraphics and Island Home Services.
WHEREAS, The Association has to date paid out approximately $58,000 in clean up and restoration expense via the regular operating budget by prudent use of the annual assessment (dues)..
WHEREAS, Operating funds are insufficient for the proposed restoration project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF THE ASSOCIATION:
The Restoration Project, as developed by the Restoration Committee, with such changes as may be approved by the President of the Association, in consultation with the Board of the Association be and hereby is adopted and approved; and A Special Assessment to finance the Restoration Project, in the amount of $1,500 per lot be and is hereby authorized and recommended by this Board, and directed to be submitted for approval by the members of the Association at the 2025 annual meeting of the Association membership or at any special meeting of the membership called for such a purpose.
