For many years CSM has relied on the City of Sanibel residential rental rules - a minimum rental of 28 consecutive days. The State of Florida is again considering legislation that would impact home rule, effectively diminishing the City of Sanibel's ability to self govern. Current City residential rental rules are potentially at risk. Your Board is considering mirroring the current City rule (minimum 28 consecutive days) with an amendment to our covenants. This covenant would be enforceable, even if the City lost its ability to regulate rentals.. I would like to get a sense of our members' thoughts on this issue. Please let me know what you think.

The Association has learned that the Sanibel City Council recently adopted an ordinance designed to more effectively monitor and enforce compliance with the City’s restrictions on rentals. While the ordinance does not change the existing requirement that rentals in communities such as ours be for NO LESS THAN four consecutive weeks, it does impose new registration and licensing requirements on all owners of rental units, beginning January 1, 2020. The ordinance is attached and we will also post it on the CSM website.
We have been informed by the City Attorney that the Planning Division of the Sanibel Community Services Department is in the process of preparing the registration application that owners will be required to complete in order to obtain the required rental license and subsequent annual renewals. City Council has not yet determined the registration/license fees, but they expect that to be an agenda item at the 12/3 City Council meeting.
If you are a renter, we suggest that you familiarize yourself with this new ordinance and be on the lookout for updates from the City Planning Division as to the registration/licensing process.
It is encouraging that the city of Sanibel is looking out for residential neighborhoods like ours in order to discourage constant turnovers of rentals and to maintain our peaceful environment.
